1. Introduction
These Terms and Conditions (“Terms”) govern the use of the Driber mobile applications and website (collectively, the “Platform”), including Driber, Driber Eats, and Driber Freight, operated by Driber Technology FZ-LLC (“Driber,” “we,” “our,” or “us”).
By downloading, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our [Privacy Policy].
2. Definitions

User – any individual or entity using the Platform.

Driver / Courier – an independent contractor providing rides, deliveries, or freight services via the Platform.

Merchant / Partner – restaurants, stores, or logistics providers using the Platform.

Wallet / Credit – any in-app monetary or promotional balance.

Services – ride-hailing, food delivery, and freight facilitation provided through the Platform.

Supported Regions – countries or territories where Driber officially operates.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement.
Minors and individuals previously banned by Driber may not use the Platform.
4. Account Registration
Users must create an account with accurate, complete, and current information.
You are responsible for safeguarding login credentials and all activity under your account.
Driber may verify identity, documents, and location to maintain platform integrity.
5. Services and Platform Role
Driber provides a technology platform connecting Users with independent drivers, couriers, and merchants.
Driber does not itself provide transportation, delivery, or freight services and has no employment relationship with service providers.
6. Territorial Scope and International Use
Driber operates only within its Supported Regions.
Use of the Platform in countries where Driber has not officially launched or where local laws restrict such services is at the user’s own risk.
Driber is not responsible for non-compliance with local regulations outside Supported Regions.
7. Payments, Wallets, and Credits
All fares, delivery fees, commissions, and applicable taxes are displayed within the Platform prior to confirmation.
Payments are processed by certified third-party providers; Driber does not store full payment-card data.
Wallet balances and promotional credits are non-transferable and may be governed by expiry or usage rules displayed in-app.
8. Account Suspension and Credit Freezing
Driber may suspend, restrict, or permanently terminate any account that:

violates these Terms;

engages in fraudulent, abusive, or unsafe behavior;

manipulates fares, orders, or promotions; or
-
endangers other users or damages Driber’s reputation.
Driber may temporarily or permanently freeze wallet balances, promotional credits, or pending payouts if funds are suspected to originate from misuse or fraud, or when retention is required by law or to compensate verified losses.
Following an internal review, such funds may be forfeited permanently to offset damages.
Affected users will be notified and may appeal within 14 days to legal@driber.com.
9. Cancellations and Refunds
Cancellation and refund policies differ by service type and are displayed in-app.
Late cancellations may incur fees.
Refunds are evaluated case-by-case and processed through the original payment method.
10. User Conduct
Users agree to:

behave respectfully toward drivers, couriers, merchants, and staff;

comply with all applicable laws;
-
not interfere with the Platform, falsify information, or commit fraud;

not use the Platform for unlawful or harmful purposes.
Violations may lead to immediate suspension, legal action, and permanent credit forfeiture.
11. Driver / Courier and Partner Obligations
Drivers, couriers, and partners act as independent contractors and must:

maintain valid licenses, insurance, and permits;
-
comply with local transportation, delivery, and food-safety laws;

ensure professional service and safety at all times.
Driber is not liable for their acts or omissions.
12. Liability and Indemnification
To the maximum extent permitted by law:

Driber shall not be liable for indirect, incidental, or consequential damages.

Driber’s total liability in any claim is limited to the total amount paid by the User for the specific transaction within the 12 months preceding the claim.

Users indemnify and hold harmless Driber from any third-party claims arising from their use of the Platform or violation of these Terms.
13. Intellectual Property
All content, trademarks, graphics, interfaces, and software are owned by or licensed to Driber.
Unauthorized reproduction, distribution, or modification is prohibited.
14. Privacy and Data Protection
Your use of the Platform is governed by the Driber Privacy Policy, which complies with GDPR and other major data-protection laws.
By using the Platform, you consent to the collection, use, and international transfer of data as described therein.
15. Anti-Fraud, AML, and Sanctions Compliance
Users must not use the Platform for illegal or sanctioned activities.
Driber conducts KYC, AML, and fraud-prevention checks and may report suspicious activity to relevant authorities.
16. Termination
Driber may terminate these Terms and your access to the Platform at any time for cause or legal requirement.
Termination does not affect accrued rights or obligations.
17. Governing Law and International Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.
However, if mandatory consumer-protection laws in your country of residence provide stronger rights, those rights prevail to that extent.
Disputes shall first be submitted to Driber’s internal resolution process; unresolved disputes may be brought before the courts of Dubai, UAE, unless local law requires otherwise.
18. Modifications to Terms
Driber may modify these Terms at any time.
Material updates will be announced via in-app notice or email, and continued use after notice constitutes acceptance.

20. Entire Agreement
These Terms constitute the entire agreement between you and Driber regarding the use of the Platform and supersede any prior agreements or understandings.
